Terms of Use

By accessing the digital domains of BoC (as defined below), you agree to be bound by the following provisions. Please review these terms carefully before using any site materials or instructional content.
1. Overview and Parties
These Terms of Use govern the websites and educational platforms managed by BoC.
Throughout this document:
“we”, “us”, and “BoC” refer to The Garage Entertainment Limited d/b/a Business of Creativity (company number 13863411), a Whalar Group Limited subsidiary registered in England and Wales.
“User”, “You”, and “Customer” refer to all site visitors and service recipients.
2. Provision of Services and Support
BoC offers digital products and course subscriptions accessible via this website (“Courses”), designed to equip individuals and business professionals with strategic tools and confidence to unlock creative potential (collectively, the “Services”).
Access
We provide access to our Services subject to this Agreement and payment of the applicable fees outlined in the Order Form (each a “License”).
Service Evolution
We may modify or update our Services at our discretion to maintain quality and relevance. If changes significantly impact your access, we will notify you.
Uptime and Maintenance
We may suspend access for maintenance or in cases of material breach, including non-payment. For planned downtime, we will provide at least five (5) days’ notice.
Support
Standard support is available Monday to Friday, 9:00am to 5:00pm GMT.
3. User Conduct and Account Responsibilities
Licensing
A License becomes active once a learner receives account access details. Licenses are non-transferable, revocable, non-exclusive, and limited to use of the Services.
Prohibited Actions
You must not:
Decompile or reverse-engineer the platform
Create derivative works
Use the platform for external commercial purposes beyond internal training
Content Standards
You must not upload or transmit content that is illegal, harmful, defamatory, or obscene.
Security
You are responsible for maintaining the confidentiality of your login credentials and all activity under your account.
Third-Party Services
Our Services may rely on third-party APIs. BoC is not responsible for their performance or availability.
4. Confidentiality
Both parties agree to protect “Confidential Information”, including non-public business information, trade secrets, and pricing terms.
Non-Disclosure
Confidential Information must not be disclosed to third parties except to authorised personnel who require access.
Exceptions
Confidentiality obligations do not apply where information:
Was already known
Becomes public without breach
Must be disclosed by law
In cases of required disclosure, the receiving party will:
Notify the disclosing party where possible
Seek confidential treatment
Cooperate to limit disclosure

5. Intellectual Property and Data
BoC and its licensors retain all rights, title, and interest in the Services and associated materials.
Usage Rights
You are granted a limited, non-transferable, revocable right to use the Services for internal purposes during the contract term.
Attribution
Where written consent is provided for external use, you must credit BoC and follow branding guidelines.
Aggregated Data
We may use anonymised usage data to improve Services and measure performance metrics such as Net Promoter Score (NPS).
6. Financial Terms
Payment
You agree to pay all applicable fees as outlined in your Order Form or at the point of purchase. Failure to pay may result in immediate suspension of access.
Unauthorised Use
If usage exceeds your licensed capacity, access may be paused and additional fees applied.
Late Fees
Overdue payments may incur interest at 8% above the Bank of England base rate.
VAT
All prices exclude VAT unless stated otherwise.
Audits
BoC reserves the right to audit usage to ensure compliance with licensing terms.
Price Changes
We may update pricing at any time. However, confirmed purchases will not be affected.
7. Duration and Termination
No Termination for Convenience
You may not terminate this agreement early without cause.
Termination for Breach
Either party may terminate if a material breach is not resolved within 30 days of written notice.
Asset Disposal
Upon termination, confidential materials must be destroyed, except where retention is required by law.
Access Duration
Access is granted for the duration of the Course plus an additional two (2) months. After this period, access may be removed at BoC’s discretion.
8. Warranties and Disclaimers
Software Integrity
BoC warrants that its software will not contain malicious code.
Educational Use Only
Content is provided for educational purposes and does not constitute legal advice.
As-Is Basis
Services are provided without implied warranties, including merchantability or fitness for purpose, to the extent permitted by law.
No Guarantee of Results
BoC does not guarantee specific outcomes from use of the Services.
9. Consumer Contracts Regulations 2013
By purchasing Services, you agree that delivery begins immediately upon payment. As a result, you waive your statutory right to cancel during the cooling-off period.
10. Limitation of Liability
BoC is not liable for indirect or consequential losses, including lost profits or business interruption.
Total liability is limited to the fees paid for the relevant Services.
11. Governing Law
These Terms are governed by the laws of England and Wales.
Any disputes will be subject to the exclusive jurisdiction of the courts of England and Wales.
